Terms of Service

These Terms of Service ("Terms") govern your use of the PitchView AI mobile application and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PitchView AI lets you photograph a space, describe a change, and generate AI-created concept images ("Renders"). Renders are produced by third-party AI models based on your inputs.

2. Accounts

You must provide a valid email address and keep your credentials secure. You are responsible for activity on your account. You must be at least 16 years old (or the age of digital consent in your country) to use the Service.

3. Plans, quotas, and billing

• Free plan: 3 Renders total (lifetime).
• Pro plan ($29.99/month): 10 Renders per day, resetting at midnight UTC. Unused Renders do not roll over.
• Quotas are enforced server-side. Attempting to circumvent quotas is a violation of these Terms.
• Subscriptions are billed and auto-renewed through the Apple App Store or Google Play, and can be cancelled anytime in your store account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled per the applicable store's policy.
• Prices may change; changes apply from the next billing period after notice.

4. Your content

You retain all rights to photos you capture or upload. You grant us a limited license to transmit and process your photos and prompts solely to generate the Renders you request. Renders are stored locally on your device; you are responsible for backing them up.

You represent that you have the right to photograph and process the images you submit (e.g., you have permission from the property owner where required) and that your content does not infringe anyone's rights.

5. Renders are concepts, not guarantees

Renders are illustrative concepts only. They are not architectural drawings, engineering documents, cost estimates, or promises of a construction outcome. They may contain inaccuracies, impossible geometry, or details that cannot be built. You must not present Renders to clients or third parties as guaranteed results, and you are solely responsible for how you use them in commercial dealings. Shared Renders carry a "Concept only — not a guarantee" note; do not remove or obscure it in client-facing use.

6. Acceptable use

You agree not to:

• Generate unlawful, infringing, deceptive, or harmful content
• Upload images of identifiable people without their consent
• Use Renders to misrepresent a property's condition (e.g., in real-estate listings presented as actual photos)
• Reverse-engineer, abuse, overload, or circumvent quotas or security of the Service
• Resell or provide the Service to third parties as your own

7. Third-party services

The Service depends on third-party providers (authentication, AI image generation, subscription processing, app stores). Their availability affects the Service, and their terms may apply to relevant parts of your use.

8. Intellectual property

The App, website, brand, and design are our property or that of our licensors. To the extent permitted by law and by our AI provider's terms, we assign or license to you the rights we hold in the Renders generated from your inputs, for your personal and business use.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Renders will be accurate, realistic, or fit for any specific purpose.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or business, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or abuse the Service. Upon termination, your right to use the Service ends; content stored locally on your device remains under your control.

12. Changes to these Terms

We may update these Terms. Material changes will be announced in the App or on this page. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Republic of Poland, without prejudice to mandatory consumer protections of your country of residence. Disputes will be resolved by the competent courts of Warsaw, Poland, unless mandatory law provides otherwise.
